Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Yannis Achour, an individual established in France (“miraviel,” “we,” “us”) governing your access to and use of miraviel.app and its features (the “Service”). By accessing or using the Service, or by confirming that you are 18 or older, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

The Service contains explicit, adults-only material. You may use it only if you are at least 18 years old (or the age of majority in your jurisdiction, if higher) and it is legal for you to view adult content where you are. By using the Service you represent and warrant that you meet these requirements.

You are responsible for ensuring that others, including minors, cannot access the Service through your device or account.

miraviel generates interactive fiction — story text, images, video, and audio — from prompts and choices you provide, using third-party AI models. Characters, scenes, and events are fictional and machine-generated; they are not real people or events. The Service is provided for personal entertainment. We may add, change, or remove features at any time.

You are responsible for the activity that occurs under your account and for keeping your credentials secure. Provide accurate information, keep it current, and notify us promptly of any unauthorized use. We may refuse, suspend, or terminate accounts as described in these Terms.

You agree not to use the Service to create, request, upload, or share content, or to behave, in any of the following ways. You must not:

• generate or seek any sexual or suggestive content involving minors, or any real or fictional person depicted as, or appearing to be, under 18 — see the zero-tolerance section below;
• create sexual or intimate content depicting a real, identifiable person without their consent, including “deepfake” or look-alike depictions of real individuals;
• depict or promote non-consensual sexual acts, sexual violence, or trafficking as if real, or otherwise glorify sexual harm;
• produce content that is illegal where you are, or that promotes terrorism, violent extremism, self-harm, or serious harm to others;
• harass, threaten, defame, dox, impersonate, or infringe the rights (including intellectual-property and privacy rights) of others;
• attempt to bypass safety systems, age gating, rate limits, or access controls; scrape, reverse-engineer, or overload the Service; or use it to build a competing model or dataset;
• use the Service for any unlawful purpose or in violation of these Terms or a third-party provider’s policies.

We may use automated and human moderation to enforce these rules and may remove content or restrict accounts that violate them. Our Privacy Policy describes how content is screened and how moderation events are handled.

We have zero tolerance for any content that sexualizes minors. This is prohibited without exception, whether the depiction is of a real person or is entirely fictional, drawn, or AI-generated, and regardless of any stated age. Any attempt to create such content violates these Terms and, we believe, the law.

We will suspend or terminate accounts involved in such activity, preserve relevant records, and report apparent child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and/or other appropriate authorities as required or permitted by law. The same applies to other clearly illegal content, including credible threats of violence.

Your inputs. You retain whatever rights you have in the prompts and instructions you provide (“Inputs”). You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display your Inputs and the resulting outputs solely to operate, secure, and improve the Service, and to route your Inputs to the AI providers that generate your content.

Your outputs. Subject to these Terms and the terms of the underlying AI providers, we assign to you whatever rights we hold in the images, video, audio, and text generated for you (“Outputs”), so you may use them for personal purposes. Because of how generative AI works, similar or identical Outputs may be produced for other users, and Outputs may not be eligible for copyright protection. You are responsible for your use of Outputs.

You represent that your Inputs and your use of Outputs do not violate these Terms or the rights of others.

Outputs are generated by artificial intelligence and may be inaccurate, offensive, or unexpected, and may not reflect real people, facts, or events. Outputs are fiction and are not advice of any kind (including legal, medical, financial, or relationship advice). Do not rely on them as statements of fact. You are solely responsible for how you interpret and use Outputs.

The Service is currently offered without charge. If we introduce paid features, subscriptions, or credits, we will present the applicable prices and additional terms (including billing, renewal, and refund terms) before you purchase, and those terms will form part of this agreement.

The Service — including its software, design, branding, and the “miraviel” name and marks — is owned by us or our licensors and protected by intellectual-property laws. These Terms grant you a limited, revocable, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works of the Service except as allowed by law.

The Service relies on third-party AI, hosting, storage, and authentication providers. Your use of features powered by these providers may also be subject to their terms, and we are not responsible for their acts, omissions, or availability. See our Privacy Policy for how your content is processed by these providers.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if we believe you have violated these Terms, to comply with law, or to protect the Service or others. Upon termination, the licenses you granted for content already processed survive to the extent needed to operate and secure the Service and to comply with law; sections that by their nature should survive (including ownership, disclaimers, limitations of liability, and indemnification) will continue to apply.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, secure, or error-free, or that Outputs will meet your expectations. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

To the maximum extent permitted by law, miraviel and its officers, employees, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the total amount you paid us, if any, in the 12 months before the claim or EUR 100. Some jurisdictions do not allow these limits, so they may not fully apply to you.

You agree to defend, indemnify, and hold harmless miraviel and its providers from claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Inputs, your use of Outputs or the Service, or your violation of these Terms or the rights of others.

These Terms are governed by the laws of France, without regard to conflict-of-laws rules. You agree that any dispute relating to these Terms or the Service will be submitted to the competent courts of Paris, France, except where mandatory consumer-protection law in your country of residence grants you the right to bring proceedings before your local courts.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide additional notice as required. Your continued use of the Service after an update means you accept the revised Terms.
